Terms and Conditions for The Shine Mosaic

These Terms and Conditions ("Agreement") govern the use of services provided by The Shine Mosaic ("Company") including but not limited to property, web design, and business automation with workflow services. By using our services, you agree to be bound by these terms and conditions.
1. Property Clause:
Any property sold or transferred through our services remains the property of the Company until full payment is received. The Company reserves the right to repossess any property in the event of non-payment.
2. Sale of Service:
The Company offers web design and business automation services. By engaging with these services, you agree to the terms outlined in our service agreement.
3. Payment:
Client agrees to pay Designer a total fee for the Services. Payment shall be made in two installments as follows:
i) 50% of the total fee shall be paid as a non-refundable deposit upon the execution of this Agreement.
ii) The remaining 50% of the total fee shall be paid upon completion of the website design and before the final delivery of files or publication of the website.
b) Payment shall be made via Stripe or PayPal. Any additional costs incurred beyond the scope of this Agreement shall be discussed and agreed upon by both parties in writing before work proceeds.
3. Termination:
a) Client acknowledges that Designer reserves the right to terminate Services if payment is not received within 10 days after the completion of the project. In the event of termination due to non-payment, Client shall not be entitled to any refunds of the deposit or any other payments made.
4. Consumer Protection Law:
We adhere to all relevant consumer protection laws. If you have any concerns regarding your rights as a consumer, please contact us immediately.
5. Links to Other Websites:
Our website may contain links to third-party websites. These links are provided for your convenience only. The Company has no control over the content of these websites and accepts no responsibility for any loss or damage that may arise from your use of them.
6. Limitation of Liability:
The Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use our services.
7. Indemnity:
You agree to indemnify and hold harmless the Company, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of our services.
8. Applicable Law:
This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States of America. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of the State of California.
9. Severability:
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. Changes:
The Company reserves the right to update or modify these terms and conditions at any time without prior notice. Your continued use of our services after any such changes shall constitute your acceptance of the new terms and conditions.
